All payments are processed by Paddle, our payment processor and merchant of record. As such, all refund requests are subject to Paddle's review and approval. Paddle may refuse refunds if there is evidence of fraud, refund abuse, or manipulative behavior.
If you are a consumer in a jurisdiction with statutory cancellation rights, you may have the right to cancel your purchase within 14 days without providing a reason. In no event shall our total aggregate liability arising out of or related to the Service exceed the greater of (a) the total fees you paid to us in the twelve (12) months preceding the event giving rise to the claim, or (b) fifty US dollars (US $50). Submission data is retained according to our data retention schedule (currently a maximum of three years from submission, with dashboard visibility varying by plan) and is automatically deleted thereafter. You are responsible for exporting or backing up any data you wish to retain. To the maximum extent permitted by law, we are not liable for any loss, deletion, or corruption of data, and you are responsible for maintaining your own backups.
The Service is provided on an "as available" basis. We do not guarantee uninterrupted or error-free operation and provide no service-level commitment unless expressly agreed in writing. We may modify, suspend, or discontinue any part of the Service at any time, and shall not be liable for any resulting unavailability.
We shall not be liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, government action, labour disputes, internet or telecommunications failures, or failures of third-party service providers or infrastructure.
You may not assign or transfer your rights under this Agreement without our prior written consent. We may assign or transfer our rights and obligations under this Agreement, including in connection with a merger, acquisition, reorganisation, sale of assets, or transfer to an affiliated or successor entity, without your consent.
If any provision of these Terms is held invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
This Agreement constitutes the entire agreement between you and Web3Creative regarding the Service and supersedes any prior or contemporaneous understandings, whether written or oral. No failure or delay by us in exercising any right under this Agreement shall constitute a waiver of that right, and no waiver shall be effective unless made in writing.
We may update these Terms and Conditions from time to time. Any changes will be posted on this page with a revised date. Continued use of the service constitutes acceptance of the updated terms.
In the event of any dispute, the parties shall first attempt to resolve it amicably through good-faith negotiation. If unresolved within thirty (30) days, the dispute shall be referred to arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Palakkad, Kerala, India, and the proceedings shall be conducted in English. This clause does not prevent either party from seeking injunctive relief from a court of competent jurisdiction.
These Terms and Conditions are governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Subject to Section 24 (Dispute Resolution), the courts at Palakkad, Kerala, India shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.
